Neglected Child for Religious Reasons (statute)

2151.03 Neglected child defined – failure to provide medical or surgical care for religious reasons.

(A) As used in this chapter, “neglected child” includes any child:

(1) Who is abandoned by the child’s parents, guardian, or custodian;

(2) Who lacks adequate parental care because of the faults or habits of the child’s parents, guardian, or custodian;

(3) Whose parents, guardian, or custodian neglects the child or refuses to provide proper or necessary subsistence, education, medical or surgical care or treatment, or other care necessary for the child’s health, morals, or well being;

(4) Whose parents, guardian, or custodian neglects the child or refuses to provide the special care made necessary by the child’s mental condition;

(5) Whose parents, legal guardian, or custodian have placed or attempted to place the child in violation of sections 5103.16 and 5103.17 of the Revised Code;

(6) Who, because of the omission of the child’s parents, guardian, or custodian, suffers physical or mental injury that harms or threatens to harm the child’s health or welfare;

42 U.S.C. 1396f. Similarly, although Congress granted HHS authority to conduct research, experiments, and demonstrations related to occupational illnesses in the Occupational Safety and Health Act of 1970, such authority did not include the power to require “medical examination, immunization, or treatment for those who object thereto on religious grounds, except where such is necessary for the protection of the health or safety of others.” 29 U.S.C. 669(a)(5).

Summary of Content
39 states, the District of Columbia and Guam have laws providing that parents or caretakers who fail to provide medical assistance to a child because of their religious beliefs are not criminally liable for harm to the child. There is also no Federal requirement that a parent or legal guardian provide a child any medical treatment that is against the religious beliefs of the parent or legal guardian.1
At the time Congress passed the Child Abuse Prevention & Treatment Act in 1974 to create a uniform approach to child abuse, it deferred to the Department of Health, Education and Welfare (now Health and Human Services) to determine the religious exemption policies of the act.2 HEW mandated that the states adopt religious exemptions to child neglect before they could receive federal funding for state child-protection programs.3 Although the department adopted new regulations in 1983 striking down this requirement,4 few states have repealed these religious exemption laws. Most of these statutes require that in order for religious beliefs to be a valid reason for denying a child medical care, the religion must be a recognized church or a religious denomination. The Supreme Court had not addressed whether or not neglect exemptions for religious purposes violate the Establishment Clause.5

VLA COMMENT: Then why have judges forced medical treatments such as chemotherapy on underaged children such as those in the Amish community?

Misadventures with the Chickenpox Vaccine, Gary Goldman, Ph.D.

Gary Goldman, Ph.D., presents his varicella vaccine findings and whistleblower experience as a lead research analyst in the Antelope Valley Varicella Active Surveillance Project. He describes how a national chickenpox vaccine program altered the epidemiology of shingles, and ways in which the CDC manipulated data to conceal the unwanted outcomes that occurred.

VLA Comment: Dr. Goldman was hired by the CDC to participate in their study on Chicken Pox. What he found out was that the CDC was manipulating data when he discovered that there were increased cases of Shingles, even in children.

Cochrane Report on Flu deaths and the flu vaccines

Excerpt: More recently, the US Centers for Disease Control and Prevention (CDC) have proposed estimates of impact ranging between 3,000 and 49,000 yearly deaths. When actual death certificates are tallied, influenza deaths on average are little more than 1,000 yearly. So, the actual threat is unknown (but likely to be small) and so is the estimation of the impact of vaccination.

In healthy adult trials a high serological response is matched by a very small clinical effect (71 healthy adults need to be vaccinated to prevent one of them experiencing influenza). This weak effect cannot be explained simply by the mismatch of vaccine antigens with wild virus ones. A larger effect is observed in children over the age of two (five children need to be vaccinated to prevent one case of influenza, although there is huge uncertainty around these estimates). There is little evidence on prevention of complications, transmission, or time off work. Other reviews have drawn similar conclusions.5

VACCINES: Trump’s new office of Freedoms of conscience and religious exercise WOW WOW

The opening paragraph is remarkable:

“The freedoms of conscience and of religious exercise are foundational rights protected by the First Amendment to the U.S. Constitution and by Federal statutes. These laws ensure, for example, that Americans are not compelled to speak, to salute the flag, to join a national church, or to vote for a particular candidate. They also ensure that as a general matter, the Federal government may not discriminate against its citizens for the views they hold.”

Among the long list of exemptions in federal law from compulsory health care and services on THE VERY FIRST PAGE is “immunizations.”

On the second page is a quote from United States v. Seeger, a 1965 Supreme Court case.

“[B]oth morals and sound policy require that the State should not violate the conscience of the individual. All our history gives confirmation to the view that liberty of conscience has a moral and social value which makes it worthy of preservation at the hands of the state. So deep in its significance and vital, indeed, is it to the integrity of man’s moral and spiritual nature that nothing short of the self-preservation of the state should warrant its violation; and it may well be questioned whether the state which preserves its life by a settled policy of violation of the conscience of the individual will not in fact ultimately lose it by the process.”

WOW! Now that’s a Supreme Court I can support!

How about this from Trump’s Executive Order of May 8, 2017? Federal law

“protects not just the right to believe or the right to worship; it protects the right to perform or abstain from performing certain physical acts in accordance with one’s beliefs.”

One of the LISTED “Problems that the Proposed Rule Seeks to Address,” is “being required to administer or receive certain vaccinations derived from aborted fetal tissues as a condition of work or receipt of educational services.” READ MORE…

Chairman of Israel Medical Association: FLU SHOT HOAX

The Jerusalem Post recently reported that Prof. Leonid Eidelman, chairman of the Israel Medical Association and the next president of the World Medical Association, opposes mandatory flu vaccinations for doctors, and he opposes identifying which doctors have been vaccinated for the flu, and which ones have not. VLA COMMENT:  As good as this sounds…notice he is opposing the vaccine for Doctors…but not for patients…but I think people will get the implications that if Doctors and Nurses don’t want it…people won’t want it.

The flu vaccine is, by far, the most prosperous vaccine produced and sold in the U.S., with over 300 million doses produced annually. It is also the leading vaccine, by far, injuring and killing people as evidenced by the quarterly Department of Justice (DOJ) reports of vaccine injury and death compensations by the Vaccine Court. In the U.S., one cannot sue a pharmaceutical company for injuries or deaths related to vaccines. READ MORE…

You might also communicate to the Republican leaders of the houses that  President Trump has set up a new office at the HHS for religious freedom (in case they haven’t heard) so that Republicans will vote as a unified party on the issue of religious freedom and vaccines.  Although the new agency only mentions vaccines as it pertains to religious freedom and medicaid, the head of the Agency, who I understand is a deeply religious acolyte requests that all concerned with being denied religious freedom as it pertains to vaccines, send in a complaint.
